01What can be registered as a trademark in Malaysia?

02Should I conduct a trademark search before filing?

A search is not a guarantee of registration, but it is a sensible first step. It can reveal identical or similar marks, help assess objections and reduce the risk of investing in a brand that may be difficult to register or use.

03Do I need a registered trademark agent in Malaysia?

A Malaysian applicant may file directly with MyIPO. A foreign applicant must appoint a registered trademark agent in Malaysia. Even where self-filing is permitted, professional support can help with searches, ownership, classification, specifications and responses to objections.

04What information is needed for a trademark application?

The application normally requires the applicant’s details, a clear representation of the mark, the relevant goods or services, the selected classes and any priority or translation information that applies. Ownership should be checked before filing because the trademark becomes a business asset.

05How long does trademark registration take in Malaysia?

Timing varies with MyIPO examination, the accuracy of the application and whether objections or third-party opposition arise. A straightforward application may still take many months. A filing date is secured when the application is properly submitted, but registration is not guaranteed until examination and publication are completed.

06How much are the official MyIPO filing fees?

MyIPO currently lists an application fee of RM950 per class when the pre-approved list of goods or services is used, or RM1,100 per class otherwise. Search, professional, objection, opposition and other fees are separate. Always check the current MyIPO forms and fees before filing.

07What happens if MyIPO objects or a third party opposes?

An objection and an opposition are different. An objection is raised during examination by MyIPO; an opposition is brought by a third party after publication. Both have deadlines and require a response based on the mark, the specification, evidence and applicable law.

08Does a Malaysian trademark protect my brand overseas?

No. Trademark rights are territorial. Protection in Singapore, Thailand or other markets usually requires separate national filings or an international application designating the relevant countries under the Madrid System. The right route depends on your expansion plans, budget and priority markets.
